HCS/335 Health Care Ethics and Social Responsibility
June 3, 2013 Anthem Blue Cross is a major health insurance provider with approximately 800,000 customers and has more individual policyholders in California than any other insurance provider in the United States ("Anthem BlueCross BlueShield," 2012). Anthem Blue Cross has informed some of its San Francisco base policyholders that their medications will only be available through mail order. A Consumer Watchdog group is working with a patient, for privacy reasons he does not want his identity to be known, to sue Anthem Blue Cross for discrimination. I will discuss the issues and its significance on the most effected population of the policy change, the arguments or facts used to support a proposed solution with Anthem Blue Cross and the Consumer Watchdog group, and the ethical and legal issues reported for administration. I also will explain the managerial responsibilities related to administrative ethical issues, and identify any proposed solutions. Anthem Blue Cross had informed its policyholders that their medications will be only be available by mail if they want them to be paid for. That means patients cannot directly communicate with their pharmacists on a personal basis and pick up their prescriptions at their discretion. HIV/AIDS patients believe that their relationship with their pharmacist is critical to their health care, especially in San Francisco where there are some of the most knowledgeable pharmacists on HIV/AIDS in the whole country. That information had some in the HIV/AIDS community unquestionably upset. A patient, Jon Doe for privacy reasons is working with a Consumer Watchdog group to sue Anthem Blue Cross because he says the new rules are discriminatory and illegal. ...There are many issues that arise when the patient privacy is concerned. In August of 1996, the Health Insurance Portability and Accountability Act (HIPPA) were passed into law (Van der Aa, 2000). The law is intended to improve the efficiency and effectiveness of the health care system by standardizing how to exchange data for specific administrative and financial transactions, while protecting the security and confidentiality of that information (Van der Aa, 2000). The areas addressed for HIPPA are: • Concerns that disclosure of patient medical records could result in embarrassment, insurance declination, loss of employment, or failure to be hired in a new job; • Increasing costs of data exchange in an incompatible and often competing standards environment to exchange administrative and financial data; • Implement processes and systems to reduce fraud (Van der Aa, 2000). HIPPA was signed into law, to help create a standard that will protect patient’s medical records and personal health records. This act is to help the health care employees have more control of a patient’s information and its privacy. This act also gives the patient the right to control their own information. ...Administrative Ethics Paper The journal article that I chose is about a case of privacy and confidentiality of health care employees in New Zealand and not the United States. Its relevancy though is just as important here as it was in New Zealand. New Zealand has a Privacy Act similar to the United States’ HIPAA. The article “Privacy, employees and human resources: a case report” (Mair, 2011) documents the release of an employee’s medical records to his employer, a New Zealand hospital and the resulting issues. Although administrators are highly cognizant of patient privacy and confidentiality, it can be easily overlooked when employees are involved. The article concerns an employee at a particular hospital who presented himself to that hospital’s Emergency Department for stress and anxiety connected to his employment there and his bullying and harassment by a particular nurse. He had made several complaints to the administration about this treatment by the nurse and nothing had been done. The nurse, Nurse X, who interviewed him, noted that he was at a low risk of harming himself or others. He also told Nurse X that he had submitted his resignation that day to the hospital. A doctor at the hospital assessed him and determined that he was of moderate risk to himself because the internalizing his anger could lead to suicide. The staff commented that the girls were getting burned but nothing could be done because of state and school policy. The district administrator stated “Some of the ingredients in sun screen can cause allergic reaction sin some children.” Not being able to apply sunscreen to the children, who both had very fair skin, led to the girls having to be taken to the emergency room in Tacoma, Washington. The girls both sustained second degree burns on their faces and body. The mother is outraged because the staff recognized the signs that the children were getting sunburned but because of the school policy there was nothing they could do for the children.
